CALL FOR WRITTEN SUBMISSIONS ON DRAFT TRADE MARKS REGULATIONS, 2025

The Patents and Companies Registration Agency (PACRA) hereby invites written submissions from stakeholders and members of the public on the following draft Regulations to be made under the Trade Marks Act, 2023 (Act No. 11 of 2023):

  • Trade Marks (General) Regulations, 2025
  • Trade Marks (Madrid Protocol) Regulations, 2025

The purpose of these draft Regulations is to operationalise the Trade Marks Act, 2023, streamline procedures, and enhance the efficiency and transparency of trade mark administration in Zambia, including the implementation of the Madrid Protocol for the international registration of marks.

Stakeholders are invited to submit comments, proposals for amendment or clarification, and any other observations that may assist in improving the clarity, practicality and effectiveness of the draft Regulations. In particular, submissions may wish to address:

  • the practicality of the procedures set out in the draft Regulations;
  • any provisions that may create operational or compliance challenges;
  • suggestions for improving forms, timelines or requirements; and
  • any additional safeguards or guidance considered necessary for users of the trade mark system.

The deadline for submissions is Friday, 21 November 2025.

Contributors are requested to clearly indicate the name of their organisation (where applicable), contact details, and whether the comments relate to the General Regulations, the Madrid Protocol Regulations, or both.

PACRA greatly appreciates the participation of stakeholders in this consultative process and looks forward to receiving constructive input to support the development of a robust and user-friendly trade marks regulatory framework in Zambia.
